(1) If a person's father or mother is a citizen of Nepal at the time of his birth, such person shall be a citizen of Nepal by descent.
(2) Notwithstanding anything written in sub-section (1), in the case of children born to a Nepali citizen woman who marries a foreign citizen, it shall be as per sub-section (2) of section 5.
(3) Every minor who does not have his father's or mother's address found in Nepal will be considered a citizen of Nepal on the basis of his descendants until the address of his father or mother is found, and he can take Nepalese citizenship on the basis of his descendants after reaching sixteen years of age. The child of a citizen who has obtained citizenship, if both his father and mother are citizens of Nepal, after he reaches the age of sixteen, he will receive Nepalese citizenship on the basis of descent.
(5) "A person who is born in Nepal from a mother who is a citizen of Nepal and resides in Nepal and whose father has not been identified, will acquire the citizenship of Nepal on the basis of descent.
(6) Notwithstanding anything written in sub-section (2), a person born in Nepal from a Nepali female citizen married to a foreign citizen, if both his mother and father are Nepali citizens at the time of acquiring Nepali citizenship, such a person born in Nepal shall acquire the citizenship of Nepal on the basis of descent.
(7) If it is determined that the father of a person who has obtained citizenship in accordance with sub-section (5) is a foreigner, the citizenship acquired on the basis of descent shall not be maintained and if he/she submits the certificate of citizenship obtained on the basis of descent by self-declaration that he/she has not acquired the citizenship of a foreign country based on the citizenship of the father, he/she shall obtain recognized citizenship.
(8) If the father or mother of a person who has obtained citizenship according to sub-section (3) is found, the following shall be done in relation to the citizenship obtained by him:-
(a) In case Nepalese citizenship is obtained on the basis of descent in accordance with this Act, the same details shall be added to maintain his citizenship,
(b) In case of obtaining the citizenship of Nepal according to this Act, to withdraw the citizenship obtained on the basis of descent and grant him the citizenship.
